The Fresno Police Department said a woman found him sleeping on her front lawn. The woman alerted her 72-year-old father, who then went outside to ask Gonzalez to leave.
Police say Gonzalez, who appeared drunk, assaulted the 72-year-old, knocking him to the ground. Investigators say Gonzalez also threw the man into a neighbor’s parked car, causing significant damage to it.
Police say when the daughter tried to intervene to protect her father, Gonzalez assaulted her as well.
Fearing for their safety, the homeowner fired one round from a firearm he legally possessed, striking Gonzalez. The woman’s boyfriend, who is a police officer and was off-duty, came to the home and put Gonzalez in handcuffs.
Gonzalez was taken to the hospital for his injury, where he is currently in custody and remains receiving treatment.
If convicted of all charges and allegations, Gonzalez faces a maximum sentence of four years and eight months in jail.
Gonzalez’s bail has been set to $52,000 and is scheduled to be in Fresno County court on Wednesday, Oct. 14.
