State Department warns travel to popular vacation destination could get you thrown in jail

Travelers heading to China could face years of detention under sweeping national security laws, according to an updated US State Department advisory.

Americans traveling to China face elevated risks of arbitrary detention, exit bans, and digital surveillance, per the Level 2 “Exercise Increased Caution” advisory issued by the US State Department.

The State Department added a “D” risk indicator for wrongful detention to the advisory, warning that Chinese authorities aggressively enforce broad national security laws without a fair or transparent legal process.

Under China’s sweeping security framework, officials can designate almost any document, statistic, or piece of data as a “state secret” retroactively. Routine professional, academic, or business activities that carry no risk in Western countries can be treated as criminal offenses.

“The Trump Administration has no higher priority than the safety and security of Americans,” a State Department spokesperson told VOA, emphasizing that efforts remain focused on securing the release of citizens held abroad.

The State Department highlighted several groups facing heightened scrutiny, including U.S. citizens of Chinese descent, individuals involved in commercial disputes, and anyone with current or past ties to the U.S. government, military, intelligence agencies, or law enforcement.

Chinese authorities frequently use “exit bans” during legal or commercial disputes, preventing individuals—and sometimes their relatives, including children—from leaving the country. Many travelers do not learn of an exit ban until they attempt to board a flight home.

Additionally, the advisory notes that U.S. citizens should expect their electronic communications, social media activity, and text messages to be monitored by local authorities. The State Department reported that people have been detained or deported over private messages considered ‘critical’ of Chinese authorities, even when those messages were sent outside China.

The State Department has formally designated at least two U.S. citizens in China as wrongfully detained: Chen Youlin, A Chinese American seismologist, worked on a U.S. government-funded research project studying North Korean underground nuclear tests. He was arrested in November 2024 while visiting family, accused of espionage in May 2025, and officially designated as wrongfully detained in March 2026.

The other is Min Zin, a Myanmar-born American scholar studying Myanmar politics and regional relations. He was detained in Yunnan province in June 2026 under espionage allegations and designated as wrongfully detained on August 20.

Americans planning necessary travel to China are advised to enroll in the State Department’s Smart Traveler Enrollment Program (STEP), maintain valid documentation, and arrange regular check-ins with family or employers.

“Be aware of your surroundings. Think before you take a picture,” warned Bobby Laurie, a travel expert and former flight attendant. “You could inadvertently photograph law enforcement or find yourself near a protest, which can trigger severe scrutiny from local authorities.”
